Competent Authority
Trademark registration in Turkmenistan is administered by the State Service for Intellectual Property under the Ministry of Finance and Economy of Turkmenistan, commonly known as Turkmenpatent, located in Ashgabat. The official working language is Turkmen, and the system is national.
International Agreements
Turkmenistan is a member of the World Intellectual Property Organization (WIPO), the World Trade Organization (observer status frameworks), and the Paris Convention for the Protection of Industrial Property. Furthermore, Turkmenistan is a contracting party to the Madrid Protocol concerning the International Registration of Marks, allowing international applications to designate Turkmenistan.
Who May Apply
Natural persons and legal entities engaging in commercial or industrial activities may apply. Foreign applicants without a permanent residence or a registered business entity in Turkmenistan are legally required to act through a registered representative. A signed Power of Attorney (POA) in simple written form is required; formal notarization, legalization, or apostille are generally not mandatory.
Online Filing and Search
Filings and official procedures are managed through administrative workflows with Turkmenpatent. Preliminary availability searches of the national trademark database can be conducted via local patent representation or direct registry inquiries to evaluate prior conflicting rights.
Registrable Sign Types
Trademarks may comprise words, letters, numerals, figurative elements, 3D shapes, or combinations thereof capable of distinguishing goods or services. All documentation submitted to the registry must be in Turkmen or accompanied by an accurate translation.
Classification
Turkmenistan follows the international Nice Classification system for the registration of goods and services. Multi-class applications are supported under national administrative frameworks, allowing a single application to cover multiple classes subject to class-specific fee calculations.
Examination
Turkmenpatent conducts a sequential examination process:
- Formal Examination: Reviews application completeness, document correctness, and classification requirements.
- Substantive Examination: Evaluates absolute grounds for refusal (such as distinctiveness) and relative grounds (conflicts with prior registered or pending marks on the national database).
Publication and Opposition
Applications that pass formal examination milestones are published in the Official Bulletin. Any interested third party may file a formal written objection or opposition against the registration of the trademark within the statutory pre-registration window.
Timelines
An unopposed standard trademark application typically takes an average of 12 to 18 months from initial filing to final registration certificate issuance.
Official Fees
Official state fees are denominated in Manat (TMT) (or designated foreign currency equivalents for international filers) under statutory tariff tables, covering baseline application filings, substantive examination steps, and final electronic certificate issuance per class.
Protection Duration and Renewal
Trademark protection is valid for 10 years starting from the official application filing date. Registrations can be renewed indefinitely for successive 10-year periods upon submitting a renewal request during the final year of protection, backed by a 6-month grace period subject to late surcharges.
Use Requirements
A registered trademark is vulnerable to cancellation or revocation actions if it has not been put to genuine commercial use in Turkmenistan for a continuous statutory period. Turkmenistan operates strictly on a first-to-file priority framework.
Post-Registration Procedures
Post-registration changes—including assignments, licensing agreements, changes of registrant name, or changes of address—must be formally recorded with Turkmenpatent to ensure full legal validity and enforceability against third parties.
Legal Remedies
Legal remedies include administrative cancellation proceedings before the office board, civil infringement litigation before competent courts seeking injunctions and financial damages, and border enforcement measures implemented to intercept counterfeit goods.
Country-Specific Risks and Practical Notes
Because foreign applicants must navigate local language mandates and utilize registered representatives for filing procedures at Turkmenpatent, ensuring that all powers of attorney and translation documents are verified prior to submission helps prevent administrative delays.
