Competent Authority & System
Official Authority: Swiss Federal Institute of Intellectual Property / Eidgenössisches Institut für Geistiges Eigentum (IPI / IGE).
Official Languages: German, French, and Italian (English is accepted for informal administrative communications, but specifications and register entries must be submitted in one of the three national languages).
System: National IP system based on the Federal Act on the Protection of Trademarks and Indications of Source (TmPA). Switzerland is not an EU Member State, meaning European Union Trademarks (EUTM) do not cover or extend to Switzerland.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol (since July 15, 1892 / March 17, 1997). Switzerland can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial priority filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident foreign applicants who do not have a domicile or real commercial establishment in Switzerland must designate an authorized representative or address for service located within Switzerland.
Power of Attorney (POA): A simple signed Power of Attorney is accepted when requested; notarization or Legalization/Apostille is not required unless requested under exceptional doubts by the IPI.

E-Filing: E-filing is fully operational through the official IPI portal (e-trademark), offering a statutory discount on official filing fees.
Free Trademark Search Database: Public searches are accessible free of charge via the official Swissreg Database (), as well as TMview and the WIPO Global Brand Database.
Registrable Mark Types
Types: Word, figurative/logo, combined signs, 3D shapes/packaging, color marks, sound (audio files or notation), motion, multimedia, pattern, and position marks capable of clear visual representation in the register.
Foreign Characters & Translation: Applications featuring non-Latin scripts or foreign wording must include a transliteration into the Latin alphabet and a translation into German, French, or Italian upon request.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Base Class Inclusion: The basic national filing fee covers up to 3 classes.
Class Headings: Accepted, provided they comply with standard clarity and precision guidelines.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by the IPI (distinctiveness, descriptiveness, genericness, public policy, deceptive signs, misleading indications of source/Swissness rules).
Relative Grounds: The IPI does not evaluate or refuse applications ex officio on relative grounds (prior conflicting trademarks). Conflicting prior rights are enforced strictly by third parties through opposition proceedings or court action.
Office Action Deadlines: Standard response time for formal deficiency letters or provisional refusal notices on absolute grounds is typically 2 to 3 months from official notification.
Publication & Opposition
Opposition Window: 3 months starting from the publication date of the trademark registration in the official database (Swissreg).
Standing: Owners of earlier registered national trademarks in Switzerland, international registrations designating Switzerland, pending applications with earlier priority, or well-known marks under Article 6bis of the Paris Convention.
Official Opposition Fee: CHF 800.
Timeline & Expedited Examination
Average Timeframe: Approximately 3 to 6 months from filing to registration in smooth, un-opposed cases.
Expedited Examination: Fast-track / express examination (Express-Prüfung) is available upon request and payment of an official urgency surcharge (CHF 400), guaranteeing first examination within 4 weeks.
Official Fees
Official statutory fees at the IPI (in Swiss Francs - CHF):
Base Application Filing Fee (Covers up to 3 Classes): CHF 450.
E-Filing Discount: -CHF 100 discount when filed online via e-trademark (Net e-filing fee: CHF 350).
Additional Class Filing Fee (From 4th Class onward): CHF 100 per class.
Expedited Examination Surcharge: CHF 400.
Official Opposition Fee: CHF 800.
Standard Renewal Fee (10 Years - Covers up to 3 Classes): CHF 550.

Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal applications can be filed within the final 12 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to an official late payment surcharge (CHF 50).
Use Requirements & Priority System
Priority System: First-to-file system. Priority documents can be submitted within 6 months from the initial priority filing date.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it has not been put to genuine commercial use in Switzerland for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered in the Register at the IPI to be legally binding against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions can be filed administratively with the IPI or brought before competent cantonal commercial courts. Absolute and relative invalidity claims are handled by competent civil courts or the Federal Administrative Court (Bundesverwaltungsgericht).
Customs Enforcement: Brand owners can file applications for customs border surveillance (Hilfeleistung der Eidgenössischen Zollverwaltung) with the Federal Customs and Border Security Bureau (BAZG) to detain counterfeit goods at the border.
Country-Specific Risks & Practical Insights
No European Union Trademark (EUTM) Coverage: Because Switzerland is not part of the EU or EEA, an EUTM registration does not protect brand rights in Switzerland. Direct national filings with the IPI or WIPO Madrid Protocol designations ("CH") are strictly required.
Strict "Swissness" Legislation: The IPI strictly enforces statutory "Swissness" regulations regarding geographical indications and Swiss coats of arms/crosses during absolute grounds examination. Crosses or geographical indications suggesting Swiss origin for goods not meeting statutory domestic value-added criteria will face ex officio refusal.
