Competent Authority & System
Official Authority: Swedish Intellectual Property Office / Patent- och registreringsverket (PRV).
Official Languages: Swedish (English is widely accepted for informal communications, but official applications and formal register entries must be in Swedish).
System: National IP system based on the Swedish Trademarks Act (Varumärkeslagen 2010:1877). As an EU Member State, protection in Sweden can also be obtained via European Union Trademarks (EUTM) administered by the EUIPO.
International Treaties
Madrid System: Member of the Madrid Protocol (since December 1, 1995). Sweden can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial priority filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident applicants established outside the European Economic Area (EEA) must appoint an authorized representative established within the EEA.
Power of Attorney (POA): A simple signed Power of Attorney is accepted when requested; notarization or Legalization/Apostille is not required unless explicitly requested under exceptional doubts by PRV.

E-Filing: E-filing is fully operational through PRV’s digital portal (Svensk Varumärkesdatabas / e-services).
Free Trademark Search Database: Public searches are accessible free of charge via the official PRV Trademark Database (Svensk Varumärkesdatabas), as well as TMview, EUIPO eSearch plus, and the WIPO Global Brand Database.
Registrable Mark Types
Types: Words, logos, figurative marks, 3D shapes/packaging, single colors or color combinations, sound (audio files), motion, multimedia, pattern, and position marks capable of clear visual or digital representation in the register.
Foreign Characters & Translation: Applications featuring non-Latin scripts or non-Swedish terms must include a transliteration into the Latin alphabet and a translation into Swedish or English.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided they comply with standard EU common practice (IP TRANSLATED principles) for clarity and precision.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by PRV (distinctiveness, descriptiveness, genericness, public order, and deceptive signs).
Relative Grounds: PRV does not refuse applications ex officio on relative grounds (prior conflicting trademarks). PRV performs an ex officio search report to inform the applicant of existing prior rights, but prior rights holders must actively enforce their rights through third-party opposition proceedings or court cancellation.
Office Action Deadlines: Standard response time for formal deficiency letters or provisional refusal notices on absolute grounds is typically 2 months from official notification.
Publication & Opposition
Opposition Window: 3 months starting from the publication date of the trademark application in the Swedish Trademark Gazette (Svensk Varumärkestidning).
Standing: Owners of earlier registered Swedish trademarks, EUTMs, international registrations designating Sweden, pending applications with earlier priority, well-known marks under Article 6bis of the Paris Convention, or trade names (Firma).

Average Timeframe: Approximately 3 to 6 months from filing to registration in smooth, un-opposed cases.

Official Fees
Official statutory fees at PRV (electronic submission tariff in Swedish Krona - SEK):
Base Application Fee (E-Filing - 1st Class): 2,700 SEK.
Additional Class Filing Fee (E-Filing): 1,000 SEK per class exceeding the 1st.
Paper Application Surcharge: Base fee rises to 3,900 SEK.
Standard Renewal Fee (10 Years - E-Filing 1st Class): 2,700 SEK.
Renewal Additional Class Fee (E-Filing): 1,000 SEK per class.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal applications can be filed within the final 6 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to an official late payment surcharge.
Use Requirements & Priority System
Priority System: First-to-file system. Priority documents can be submitted within 3 months from the filing date.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it has not been put to genuine commercial use in Sweden for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered in the Register at PRV to be legally binding against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Direct administrative invalidity and non-use revocation actions can be submitted administratively to PRV, as well as through the specialized Patent and Market Court (Patent- och marknadsdomstolen at the Stockholm District Court).
Customs Enforcement: Brand owners can file applications for customs border surveillance with Swedish Customs (Tullverket) under EU Customs Regulation (EU) No 608/2013 to intercept counterfeit goods at the border.
Country-Specific Risks & Practical Insights
Informational Search vs. Relative Refusal: PRV conducts relative searches and provides a courtesy notice of prior conflicting marks, but does not refuse the application ex officio on relative grounds. Earlier rights holders must file a formal opposition within the 3-month window.
Specialized IP Judiciary: Appeals from PRV and commercial IP disputes are handled by specialized courts—the Patent and Market Court (Patent- och marknadsdomstolen) and the Patent and Market Court of Appeal (Patent- och marknadöverdomstolen).
