Competent Authority & System
- Official Authority: Ministry of Commerce and Industry, Mogadishu. Trademark applications are made there, in person.
- Legislation: the Somali Trade Mark Law.
Applicant & Representation Requirements
- Who may apply: individuals and companies, domestic and foreign. Any person or corporation that owns a mark used, or proposed to be used, in Somalia may apply.
- Representatives: a power of attorney is needed only when a representative files for the applicant.
- Documents: a copy of a passport or ID card, the business licence and company profile, a trademark registration request letter, a notarized trademark verification, a PNG image of the trademark with a professional description, and the power of attorney if a representative is used. Foreign companies also provide proof of their original country registration.
Online Services & Database
- Search: the first step is a search to check whether the mark is available. The Ministry's pages state that it carries no fee.
Examination Process
- Application: the application is filed with the fees and gives the mark, the class of goods or services, and the applicant's details.
- Examination: the application is examined for registrability and for conflicts with existing marks.
Publication & Opposition
- Publication: the mark is advertised in the local gazette and on the IP website for 35 days.
- Registration: if there is no opposition after 45 days, the registration certificate is issued once the final fee is paid.
Official Fees
- Registration: US$ 1,000, paid by mobile money transfer to the bank account shown by the Ministry.
Duration & Renewal
- Validity period: a trademark is valid for 10 years from the filing date.
- Renewal: it can be renewed indefinitely for successive periods.
