Competent Authority & System
Official Authority: Industrial Property Office of the Slovak Republic / Úrad priemyselného vlastníctva Slovenskej republiky (ÚPV SR).
Official Language: Slovak (All official specifications and correspondence must be conducted in Slovak).
System: National IP system based on Act No. 506/2009 Coll. on Trademarks. As an EU Member State, protection in Slovakia can also be obtained via European Union Trademarks (EUTM) administered by the EUIPO.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol (since January 1, 1993 / September 13, 1997). Slovakia can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial priority filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident applicants from outside the European Union (EU) or European Economic Area (EEA) must be represented by an authorized Slovak representative or advocate (advokát) registered to practice before ÚPV SR.
Power of Attorney (POA): Required when represented. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required.
Online Services & Database
E-Filing: Electronic filing is fully operational via the ÚPV SR online portal (slovensko.sk / ÚPV SR portal). Electronic filing provides a statutory fee discount.
Free Trademark Search Database: Public searches are accessible free of charge via the official ÚPV SR Register Database, as well as TMview, EUIPO eSearch plus, and the WIPO Global Brand Database.
Registrable Mark Types
Types: Verbal (word marks), pictorial/figurative (logos), combined signs, 3D shapes/packaging, color marks, sound (audio files), motion, multimedia, pattern, and position marks capable of clear visual or digital representation in the register.
Foreign Characters & Translation: Applications featuring non-Latin scripts or non-Slovak words must include a transliteration into the Latin alphabet and a translation into Slovak.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Base Class Inclusion: The basic national filing fee structure covers up to 3 classes.
Class Headings: Accepted, provided they conform to standard EU common practice (IP TRANSLATED principles) for clarity and precision.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by ÚPV SR (distinctiveness, descriptiveness, genericness, public order, deceptive signs).
Relative Grounds: ÚPV SR does not refuse applications ex officio based on prior conflicting trademarks. Protection against confusingly similar prior rights is enforced strictly through third-party opposition proceedings or post-grant court cancellation.
Office Action Deadlines: Standard response time for formal deficiency letters or provisional refusal notices on absolute grounds is typically 2 months from official notification.
Publication & Opposition
Opposition Window: 3 months starting from the publication date of the application in the Official Gazette of ÚPV SR (Vestník ÚPV SR).
Standing: Owners of earlier registered Slovak trademarks, EUTMs, international registrations designating Slovakia, pending applications with earlier priority, well-known marks under Article 6bis of the Paris Convention, or trade names.
Timeline & Expedited Examination
Average Timeframe: Approximately 5 to 8 months from filing to registration in smooth, un-opposed cases.
Fast-Track Processing: Accelerated processing is available automatically without additional fees if the application is filed electronically, fees are paid immediately, and all terms are selected strictly from pre-approved classification databases (Fast Track).
Official Fees
Official statutory fees at ÚPV SR (Act No. 145/1995 Coll. on Administrative Fees):
Application Filing Fee (Up to 3 Classes):
Paper Filing: €170.
E-Filing Discount: Reduced fee applied for electronic submissions via official portals.
Additional Class Filing Fee (From 4th Class onward): €50 per class.
Official Opposition Fee: €70.
Standard Renewal Fee (10 Years - Up to 3 Classes): €150.
Renewal Additional Class Fee: €50 per class exceeding the 3rd.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal applications can be filed within the final 12 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to an official late payment surcharge (double base renewal fee).
Use Requirements & Priority System
Priority System: First-to-file system. Priority documents can be submitted within 3 months from the filing date.
Non-Use Cancellation: A registered trademark becomes vulnerable to revocation on non-use grounds if it has not been put to genuine commercial use in Slovakia for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered in the Register at ÚPV SR to be legally binding against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and absolute/relative invalidity claims are filed administratively with ÚPV SR or brought before competent civil courts (such as the Banská Bystrica District Court).
Customs Enforcement: Brand owners can file applications for customs border surveillance with the Financial Directorate of the Slovak Republic (Customs Section) under EU Customs Regulation (EU) No 608/2013 to intercept counterfeit goods at the border.
