Who May Apply
Natural persons and legal entities engaging in commercial activities may apply. Foreign applicants who do not have a residential address or a principal place of business in Singapore are legally required to appoint a Singapore-based address for service and utilize local representation or agents when interfacing with IPOS.
Online Filing and Search
Electronic filings, document management, and database searches are fully integrated through the IPOS Digital Hub online portal. Preliminary availability searches of the national register can be conducted online free of charge.
Registrable Sign Types
Trademarks may comprise any signs—including words, personal names, letters, numerals, figurative elements, 3D shapes, colors, sounds, smells, or combinations thereof—capable of distinguishing goods or services. Non-English characters or specialized terms require translation and transliteration notes.
Classification
Singapore follows the international Nice Classification system for the registration of goods and services. Multi-class applications are fully supported, allowing a single application to cover multiple classes subject to class-specific fee calculations.
Examination
IPOS conducts a formal administrative examination for completeness, followed by a substantive examination covering absolute grounds for refusal (such as lack of distinctiveness) and relative grounds (conflicts with prior registered or pending marks on the national database). Applicants are given statutory deadlines to respond in writing to any provisional refusal or examiner objection.
Publication and Opposition
Applications that successfully pass substantive examination are published in the official Trade Marks Journal. Any interested third party may file a formal notice of opposition against the registration of the trademark within a strict statutory window of 2 months from the publication date (which can be extended up to a maximum of 4 months upon request).
Timelines
An unopposed standard trademark application typically takes an average of 6 to 9 months from initial electronic filing to final registration certificate issuance.
Official Fees
Official state fees are denominated in Singapore Dollars (SGD / S$) and vary depending on whether specifications use pre-approved terms from the IPOS database:
- Filing fee (Form TM4): S$280 per class if specifications are fully adopted from the IPOS pre-approved classification database; S$410 per class if custom descriptions are used.
- Notice of opposition filing (Form TM11): S$420 per class.
- Counter-statement filing (Form HC6): S$360 per class.
- Renewal fee (Form TM19): S$480 per class (if filed on or before expiry).
Protection Duration and Renewal
Trademark protection is valid for 10 years starting from the official application filing date. Registrations can be renewed indefinitely for successive 10-year periods upon submitting a renewal request and paying the requisite fees within the final months prior to expiration, backed by a late renewal grace period.
Use Requirements
A registered trademark is vulnerable to revocation or cancellation actions if it has not been put to genuine commercial use in Singapore for a continuous period of 5 years. Singapore operates strictly on a first-to-file priority framework.
Post-Registration Procedures
Post-registration changes—including assignments, licensing agreements, security interests, changes of registrant name, or changes of address—must be formally recorded with IPOS via the IPOS Digital Hub to ensure full legal validity and enforceability against third parties.
Legal Remedies
Legal remedies include administrative revocation and invalidation proceedings before IPOS, civil infringement litigation before the High Court of Singapore seeking permanent injunctions, damages, or statutory accounts of profits, and border enforcement measures implemented via Singapore Customs recordals to intercept counterfeit imports.
