Competent Authority & System
Official Authority: Intellectual Property Office of the Republic of Serbia / Zavod za intelektualnu svojinu (ZIS).
Official Language: Serbian (Serbian Cyrillic or Latin script; all application specifications and administrative proceedings must be conducted in Serbian).
System: National IP system based on the Serbian Law on Trademarks. Serbia is an EU candidate country, but European Union Trademarks (EUTM) do not cover or extend to Serbia.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol (since April 27, 1992 / February 17, 1998). Serbia can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident foreign applicants without a domicile or real place of business in Serbia must be represented by an authorized representative registered with ZIS.
Power of Attorney (POA): Required. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required. The POA can be submitted late upon request without strict initial filing blocks.
Online Services & Database
E-Filing: Electronic filing and administrative services are operational via the official ZIS online portal (e-Prijava).
Free Trademark Search Database: Public searches are accessible free of charge via the official ZIS Register Search portal, as well as TMview and the WIPO Global Brand Database.
Registrable Mark Types
Types: Verbal (words/letters), pictorial/figurative (logos), 3D shapes/packaging, color combinations, sounds, motion, and combined marks capable of clear visual or representation in the register.
Foreign Characters & Translation: Applications featuring non-Cyrillic or foreign words must include a transliteration into Latin/Cyrillic scripts and a Serbian translation.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Base Class Inclusion: The basic official filing fee covers up to 3 classes.
Class Headings: Accepted, provided the goods and services are clear, precise, and compliant with international standard practices.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by ZIS (distinctiveness, descriptiveness, genericness, public order, deceptive signs).
Relative Grounds: ZIS evaluates relative grounds ex officio during substantive examination and notifies applicants if prior conflicting rights exist; however, relative conflicts are primarily enforced through the formal pre-grant opposition window.
Office Action Deadlines: Standard response time for formal deficiency letters or provisional refusal notices is typically 60 days (2 months) from official notification (extendable upon request).
Publication & Opposition
Opposition Window: 3 months starting from the publication date of the application in the official IP Gazette (Glasnik intelektualne svojine).
Standing: Owners of earlier registered national trademarks, international registrations designating Serbia, pending applications with earlier priority, well-known marks under Article 6bis of the Paris Convention, or prior business names.
Timeline & Expedited Examination
Average Timeframe: Approximately 6 to 10 months from filing to registration in smooth cases without office objections or third-party oppositions.
Expedited Examination: Fast-track examination can be requested under specific statutory conditions upon payment of an official urgency fee.
Official Fees
Official statutory fees at ZIS are set in Serbian Dinar (RSD):
Base Application Filing Fee (Covers up to 3 Classes): RSD 21,390.
Additional Class Filing Fee (From 4th Class onward): RSD 4,290 per class.
Figurative / Graphic Representation Fee: RSD 4,290 surcharge per logo element.
Registration & 10-Year Maintenance Grant Fee: Standard registration issuance tariffs apply upon grant.
Renewal Base Fee (10 Years - Up to 3 Classes): Standard maintenance schedule applies.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal applications can be filed within the final 6 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to an official late payment surcharge.
Use Requirements & Priority System
Priority System: First-to-file system. Priority documents can be submitted within 3 months from the filing date.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it has not been put to genuine commercial use in Serbia for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered with ZIS to be legally enforceable against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and absolute/relative invalidity claims are examined administratively by ZIS or brought before competent civil courts (such as the Higher Court in Belgrade).
Customs Enforcement: Brand owners can file applications for customs border protection with the Customs Administration of the Republic of Serbia (Uprava carina) to intercept counterfeit goods at the border.
Country-Specific Risks & Practical Insights
No European Union Trademark (EUTM) Extension: Because Serbia is not an EU member state, an EUTM registration does not protect brand rights in Serbia. Direct national filings with ZIS or Madrid Protocol designations ("RS") are strictly mandatory.
