Official Authority: State Office for Patents and Trademarks / Ufficio di Stato Brevetti e Marchi (USBM).
Official Language: Italian.
System: National IP system based on the Industrial Property Code (Law No. 79/2005, as amended). San Marino is an independent sovereign state surrounded by Italy; it is not an EU Member State, meaning European Union Trademarks (EUTM) do not automatically extend to or cover San Marino. (Note: Under historical bilateral agreements, Italian national registrations registered prior to certain legal reforms enjoy reciprocal recognition, but direct national filings or Madrid System designations are required for independent national protection).
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol (since September 25, 1960 / September 12, 1999). San Marino can be designated in international applications via WIPO.

Applicant & Representation Requirements

Power of Attorney (POA): Required when represented. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required unless explicitly ordered under exceptional doubts.

Types: Verbal (word marks), pictorial/figurative (logos), combined signs, 3D shapes/packaging, color marks, sound, and other distinctive signs capable of clear representation in the register.
Foreign Characters & Translation: Applications containing non-Latin scripts or foreign wording must include a transliteration into the Latin alphabet and a translation into Italian.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided the goods and services are clear, specific, and conform to standard international classification practices.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by USBM (distinctiveness, descriptiveness, genericness, public order/morality, and deceptive signs).
Relative Grounds: USBM does not refuse applications ex officio on relative grounds (prior conflicting rights). Conflicting prior rights must be enforced by third parties through opposition proceedings or post-grant court cancellation.
Office Action Deadlines: Standard response time for formal deficiency letters or provisional refusal notices on absolute grounds is typically 2 months (60 days) from official notification.
Publication & Opposition
Opposition Window: 3 months starting from the publication date of the trademark application in the Official USBM Bulletin (Bollettino Ufficiale Brevetti e Marchi).
Standing: Owners of earlier registered national trademarks in San Marino, international registrations designating San Marino, pending applications with earlier priority, or well-known marks under Article 6bis of the Paris Convention.
Timeline & Expedited Examination
Average Timeframe: Approximately 4 to 8 months from filing to registration in smooth cases without third-party oppositions or formal objections.

Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it has not been put to genuine commercial use in San Marino for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered in the State Register at USBM to be legally enforceable against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and absolute/relative invalidity claims are filed with USBM or brought directly before the Single Court of San Marino (Tribunale Unico della Repubblica di San Marino).
Customs Enforcement: Brand owners can file applications for border surveillance and customs protection to intercept counterfeit goods entering the territory.

No European Union Trademark (EUTM) Extension: Because San Marino is an enclave inside Italy but not part of the EU, an EUTM registration does not cover San Marino. Rights must be secured via direct USBM national filings or Madrid Protocol designations ("SM").
