Official Authority: Federal Service for Intellectual Property / Федеральная служба по интеллектуальной собственности (ROSPATENT). Examination is conducted through its operational arm, the Federal Institute of Industrial Property (FIPS / ФИПС).
Official Language: Russian (All application documents, specifications, and administrative correspondence must be submitted in Russian).
System: National IP system based on Part IV of the Civil Code of the Russian Federation.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol (since October 29, 1976 / June 10, 1997). Russia can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial priority filing date.
Applicant & Representation Requirements
Entitlement: Legal entities and individual entrepreneurs (natural persons) are eligible to apply.
Representation for Foreign Applicants: Non-resident foreign applicants who do not have a registered domicile or real commercial establishment in the Russian Federation must be represented by an authorized local Russian Patent/Representative registered with Rospatent.
Power of Attorney (POA): Required when represented. A simple signed Power of Attorney (with corporate seal, if applicable) is accepted; notarization or Legalization/Apostille is not required unless requested under specific doubts by Rospatent.
Online Services & Database
E-Filing: Electronic application filing is fully operational via Rospatent/FIPS digital portals, offering a 30% discount on official statutory filing and examination fees for electronic submissions.
Free Trademark Search Database: Public searches can be conducted via official Rospatent open registers, as well as TMview and the WIPO Global Brand Database.
Registrable Mark Types
Types: Verbal (word marks), pictorial/figurative (logos), three-dimensional (shapes/packaging), sound, motion, color, light, holographic, tactile, olfactory, and combined designations capable of distinguishing goods or services.
Foreign Characters & Cyrillic Translation: Applications containing non-Cyrillic scripts (e.g., Latin characters) or foreign wording are accepted; however, providing a transliteration into the Cyrillic alphabet and a Russian translation is required during examination. Registering a Cyrillic version alongside Latin brand names is strongly advised for broader regional protection.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided they are sufficiently clear and precise; overly generic terms may draw examiner requests for clarification.
Examination Process
Examination Scope:
Formal Examination: Conducted within approximately 1 month to verify administrative compliance and fee payments.
Substantive Examination: Rospatent evaluates both absolute grounds (distinctiveness, descriptiveness, genericness, public policy) and relative grounds (ex officio search for prior identical or confusingly similar trademarks and pending applications).
Office Action Deadlines: Standard response time for formal deficiency notices, provisional refusal notices, or expert notifications is 3 months from the dispatch date of the official notice (extendable upon request and payment of official fees).
Publication & Opposition
Observation System (Pre-Grant): Applications are published upon completion of formal examination. Third parties may submit informal observations on absolute or relative grounds prior to the completion of substantive examination.
Post-Registration Invalidation / Opposition Window: Formal cancellation/invalidation claims based on relative grounds (earlier conflicting rights) must be filed before the Chamber for Patent Disputes (Палата по патентным спорам) at Rospatent within 5 years from the registration publication date. Invalidation claims based on absolute grounds or bad faith can be brought at any time during the validity period.
Timeline & Expedited Examination
Average Timeframe: Approximately 6 to 10 months from filing to registration in smooth cases without office objections.
Expedited Examination: Rospatent offers an official paid fast-track examination procedure (via a preliminary search report through FIPS), which can reduce the total registration timeframe to approximately 2 to 3 months.
Official Fees
Official statutory fees at Rospatent (in Russian Rubles - RUB; 30% discount applied for e-filings):
Application Filing & Formal Examination Fee: 4,000 RUB base (for up to 5 classes) + 1,000 RUB per class exceeding 5.
Substantive Examination Fee: 13,000 RUB base (for 1 class) + 2,500 RUB per additional class.
Registration & Certificate Issuance Fee (Payable upon allowance): 18,000 RUB base (for up to 5 classes) + 2,000 RUB per class exceeding 5. Certificate issuance fee: 2,000 RUB.
Standard Renewal Fee (10 Years): 20,000 RUB base (for up to 5 classes) + 1,000 RUB per additional class.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal applications can be filed during the final 12 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to an official late payment surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes vulnerable to revocation/cancellation on non-use grounds if it is not put to genuine commercial use in Russia for a continuous period of 3 years post-registration. Cancellation claims are brought by interested parties before the Intellectual Property Court (Суд по интеллектуальным правам - SIP).
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered with Rospatent to be legally enforceable against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions are handled by the Intellectual Property Court (SIP). Absolute and relative invalidity claims are filed administratively with the Chamber for Patent Disputes at Rospatent, with further appeals to the SIP.
Customs Enforcement: Brand owners can file applications for customs border recordal in the Customs Intellectual Property Register (ТРОИС) maintained by the Federal Customs Service (ФТС) to detain counterfeit goods at the border.
Country-Specific Risks & Practical Insights
Ex Officio Relative Search: Rospatent examiners conduct thorough ex officio relative searches and issue provisional refusals if prior confusingly similar marks are cited. Rejections can often be overcome by providing Letters of Consent or coexistence agreements from prior owners.
3-Year Non-Use Vulnerability: Unlike the standard 5-year non-use period applied across most European jurisdictions, Russia maintains a strict 3-year non-use window.
Dual Script Strategy: While registering a Latin-script mark provides direct protection for international brand names, filing a matching Cyrillic transliteration is highly recommended to block phonetic squatting in the domestic market.
