Competent Authority & System
Official Authority: Directorate for Internal Market and Competition – Department for Intellectual Property, under the Ministry of Economic Development (Ministarstvo ekonomskog razvoja).
Official Language: Montenegrin (Serbian/Bosnian/Croatian forms in Latin script are practically accepted).
System: National IP system. Montenegro is an EU candidate country, but European Union Trademarks (EUTM) do not currently cover or extend to Montenegro.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol (since December 4, 2006). Montenegro can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident foreign natural persons or legal entities without a domicile or real commercial establishment in Montenegro must be represented by a registered local Montenegrin patent/representative.
Power of Attorney (POA): Required. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required. The POA can be submitted within 60 days from the filing date.

E-Filing: Applications are submitted directly or via registered local representatives through the Ministry of Economic Development’s administrative portal.
Free Trademark Search Database: Public register searches are available via the official Ministry Trademarks eRegister, as well as the WIPO Global Brand Database and WIPO Madrid Monitor.
Registrable Mark Types
Types: Words, figurative signs, combined logos, 3D shapes/packaging, color combinations, sounds, and other distinctive signs capable of graphical representation.
Foreign Characters & Translation: Applications featuring non-Latin scripts or foreign wording must include a transliteration into the Latin alphabet and a translation into Montenegrin.
Classification Framework
Nice Classification: Uses the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Base Class Inclusion: The basic national filing/administrative fee framework covers up to 3 classes.
Class Headings: Accepted, provided the goods and services are clear and specified.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by the Ministry (distinctiveness, descriptiveness, genericness, public policy, deceptive signs).
Relative Grounds: The Ministry does not evaluate relative grounds ex officio. Earlier conflicting marks are enforced exclusively through third-party opposition proceedings or court cancellation.
Office Action Deadlines: Standard response time for formal deficiency letters or provisional refusal notices is typically 60 days (2 months) from official notification.
Publication & Opposition
Opposition Window: 90 days (3 months) starting from the date of publication of the trademark application in the official IP Gazette (Službeni list CG - Intelektualna svojina).
Standing: Owners of earlier registered national trademarks, international registrations designating Montenegro, pending applications with earlier priority, well-known marks under Article 6bis of the Paris Convention, or trade names.
Timeline & Expedited Examination
Average Timeframe: Approximately 10 to 14 months from filing to registration in smooth cases without office objections or third-party oppositions.
Expedited Examination: Fast-track processing can be requested under specific statutory conditions upon payment of official urgency fees.
Official Fees
Official statutory fees at the Ministry (administrative fee schedule):
Filing Fee (Up to 3 Classes): Base administrative tariff applied for 1–3 classes.
Additional Class Fee (From 4th Class onward): Additional per-class administrative surcharge.
Grant Fee: Official registration grant fee payable following the expiration of the un-opposed 90-day window.
Late Renewal Grace Period Surcharge: 50% increase on standard renewal fees.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal requests can be filed within the final 6 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to a 50% late fee surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes subject to revocation/cancellation on non-use grounds if it is not put to genuine commercial use in Montenegro for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered with the Ministry to be legally enforceable against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and absolute/relative invalidity claims are filed with the Ministry or brought before the competent Commercial Court in Podgorica.
Customs Enforcement: Brand owners can file applications for customs border surveillance with the Administration of Customs of Montenegro (Uprava carina) to detain counterfeit goods at the border.
Country-Specific Risks & Practical Insights
No EU Trademark Coverage: Because Montenegro is not an EU member state, European Union Trademarks (EUTM) do not extend to Montenegro. National filings or Madrid Protocol designations ("ME") are strictly required.
No Ex Officio Relative Search: The trademark office examines absolute grounds only. Conflicting identical or confusingly similar prior marks are not cited by examiners; brand owners must actively monitor the official gazette to file an opposition within the 90-day window.
