Competent Authority & System
- Official Authority: Economic and Technological Development Bureau (DSEDT), Macao SAR. It registers trademarks together with other industrial property rights.
- Official Languages: Chinese and Portuguese. Forms are filed in Chinese or Portuguese, and documents in another language need an officially certified translation into one of them.
Applicant & Representation Requirements
- Eligibility: the online service is open to holders of a Macao SAR resident identity card and to bodies corporate constituted under Macao law. Applicants from outside Macao act through an appointed agent.
- Power of Attorney: when an agent files, a duly authenticated power of attorney is required.
- Priority: if a priority is claimed, the documents proving it must be filed.
Online Services & Database
- Online filing: the application form (ECO-051) can be filed online through the DSEDT e-services. This needs a "Macao One Account" and a valid normalised certificate through the "eSignCloud" service for the electronic signature.
- Paper filing: the form can also be filed in person at the DSEDT Reception Center.
- Search: DSEDT lists a fee of 200 MOP for a search of the industrial property records.
Examination Process
- Refusal and opposition: the application is examined by DSEDT. Where there are grounds for refusal or an opposition, registration does not follow automatically.
Publication & Opposition
- Publication: accepted applications are published in Series II of the Official Gazette, on the first or third Wednesday of every month.
- Opposition period: two months from the publication.
Timeline & Expedited Examination
- Typical timeline: if there is no opposition and no ground for refusal, registration is granted about six months after the publication of the application.
Official Fees
- Application for registration: 1,000 MOP.
- Opposition: 800 MOP.
- Declaration of forfeiture: 800 MOP.
- Rectification: 100 MOP.
- Extension of a period: 200 MOP.
- Search: 200 MOP.
- Renewal: 2,000 MOP, or 2,500 MOP when it is made in the six months after expiry.
Duration & Renewal
- Validity period: a registration is valid for 7 years.
- Renewal: it can be renewed for successive periods of 7 years, with no limit on the number of renewals. The request must be made within the six months before the date of expiry.
- Late renewal: it can still be made in the six months after expiry, with the higher fee.
- How to renew: online through the DSEDT e-services or in person at the DSEDT Reception Center with form ECO-052.
