Official Authority: Industrial Property Agency / Agjencia për Pronësi Industriale (KIPA / API) under the Ministry of Industry, Entrepreneurship and Trade.
Official Languages: Albanian and Serbian.
System: National IP system.
International Treaties
Madrid System: Not a member. Kosovo is not a WIPO member state; protection cannot be obtained via international designations under the Madrid Protocol and requires direct national filing.
Paris Convention: Not a signatory. However, priority based on first filings in Paris Convention member states is recognized under national law within 6 months from the initial priority filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident foreign applicants without a domicile or registered business in Kosovo must be represented by an authorized representative registered with KIPA.
Power of Attorney (POA): Required. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required.
Online Services & Database
E-Filing: Submissions and formal applications are managed directly or through authorized representatives with KIPA.
Free Trademark Search Database: Public registers and official agent directories are accessible via KIPA’s portal.
Registrable Mark Types
Types: Words, logos, figurative elements, 3D shapes/packaging, color combinations, sounds, and other distinctive signs. Under the Law on Trademarks (No. 08/L-075), explicit graphical representation is no longer strictly required if the mark can be represented clearly in the register.
Foreign Characters & Translation: Applications featuring foreign words or non-Latin scripts must include a transliteration and translation into Albanian or Serbian.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Under the Law on Trademarks, general class headings are no longer accepted. Specific goods and services must be explicitly listed and identified.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by KIPA (distinctiveness, descriptiveness, genericness, bad faith, protected plant varieties/wine designations, public policy).
Relative Grounds: Examined ex officio by KIPA examiners alongside third-party opposition proceedings.
Office Action Deadlines: Standard response times for formal deficiencies or provisional refusals are typically set at 2 months (60 days) from official notification.
Publication & Opposition
Opposition Window: 3 months starting from the publication date of the application in the official IP bulletin (non-extendable).
Standing: Holders of earlier registered trademarks, pending applications with earlier priority, trade names, or well-known marks.
Timeline & Expedited Examination
Average Timeframe: Approximately 9 to 14 months from filing to registration for smooth cases.
Accelerated Examination: Fast-track processing can be requested under justified circumstances (e.g., active infringement or urgent legal proceedings) upon payment of an urgency surcharge fee.
Official Fees
Official statutory fees at KIPA are assessed in Euros (EUR):
Application Filing Fee (Up to 3 Classes): €40.
Additional Class Fee (From 4th Class onward): €5 per class.
Registration & Certificate Issuance Fee (Up to 3 Classes): €90.
Renewal Fee (10-year term): Standard maintenance fees apply per tariff schedules.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal requests can be filed up to 6 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to a late surcharge (double fee).
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it is not put to genuine commercial use in Kosovo for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate name/address must be officially registered with KIPA to be enforceable against third parties.
Document Formalities: Assignments and license recordals require a notarized agreement executed by the parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and absolute/relative invalidity claims are filed with KIPA (Appeals Commission) or brought before competent civil courts.
Customs Protection: Brand owners can file applications for customs border surveillance with Kosovo Customs (Dogana e Kosovës) to detain counterfeit or infringing goods at the border.
Country-Specific Risks & Practical Insights
No WIPO / Madrid Protection: Because Kosovo is not covered under Madrid Protocol designations (WIPO), brand owners specifying "Balkan" regional coverage must file a separate direct national application with KIPA to protect their marks in Kosovo.
No Class Headings Allowed: Under Law No. 08/L-075, applicants can no longer rely on general Nice class headings; specifications must explicitly detail every intended product or service.
Affordable 3-Class Base Structure: The base filing fee (€40) and registration fee (€90) cover up to 3 Nice classes, making multi-class protection exceptionally economical up to the 3rd class.
