- Foreign applicants residing or domiciled outside Jamaica must appoint a qualified local Jamaican trademark agent/representative with an address for service in Jamaica.
- Power of Attorney (POA): Required (Authorization of Agent). A simply signed Form TM2 / Power of Attorney is accepted; formal notarization or consular legalization/Apostille is not strictly required for routine trademark applications.

Registrable Mark Types
- Standard & Non-Traditional Marks: Words, figurative/logo designs, acronyms, 3D shapes/packaging, distinct color combinations, sound marks, collective marks, and certification marks.
- Translation & Transliteration: Applications incorporating non-English words or non-Latin scripts require an accurate certified English translation and phonetic transliteration.
Classification System
- Classification Standard: Nice Classification system.
- Multi-Class Applications: Allowed. Applicants can include multiple classes under a single application filing.
- Class Headings: Broad class headings are scrutinised; clear, precise, and itemized specifications of goods and services according to standard Nice classification terms are required.
- Class Fees: Per-class official fee structure applies.
Examination
- Examination Sequence: JIPO conducts Formal Examination to verify document compliance, followed by Substantive Examination (absolute and relative grounds).
- Absolute Grounds: Examined for distinctiveness, generic terms, descriptiveness, deceptiveness, national symbols, public order, and morality.
- Relative Grounds (Prior Rights): Examined ex officio for likelihood of confusion against prior registered marks or pending applications.
- Office Actions: Applicants are granted a statutory window to respond to official examination objections or refusals.
Publication & Opposition
- Publication: Once the application passes examination, it is published in the official Jamaica Intellectual Property Journal.
- Opposition Period: 2 months starting from the publication date in the Journal. (Extensions may be requested before expiry upon showing reasonable cause).
- Eligible Opponents: Any interested third party claiming prior rights, likelihood of confusion, or statutory absolute grounds.
Timeframe & Acceleration
- Average Timeframe: A smooth, un-opposed trademark application typically takes 10 to 18 months from filing to registration certificate issuance.
- Expedited Examination: No official fast-track fee mechanism is provided; applications are examined in order of receipt.
Official Fees
- Application Filing Fee (First Class): JMD $13,700.00.
- Additional Class Fee: JMD $4,200.00 per additional class.
- Official Registry Search Fee: JMD $4,200.00 per class (if JIPO search is requested).
- Acceptance, Publication & Registration Grant Fee: JMD $17,700.00 (payable upon acceptance prior to registration).

Term of Protection & Renewal
- Protection Period: 10 years calculated from the application filing date.
- Renewal Requirements: Renewable every 10 years indefinitely.
- Grace Period: A 6-month grace period is granted following expiration to file for late renewal, subject to a late surcharge penalty.
Use Requirements & First-to-File vs. First-to-Use
- First-to-File vs. First-to-Use: Jamaica operates primarily on a First-to-File principle, while recognizing common law protection against passing off based on prior goodwill and market use.
- Declaration of Use: Not required prior to registration or during routine 10-year renewal filings.
- Non-Use Cancellation: A registered trademark becomes vulnerable to non-use revocation (revocation for non-use) by an interested third party if it has not been genuinely used in trade within Jamaica for a continuous period of 5 years following registration, without valid reasons for non-use.
Post-Registration Transactions
- Assignments & Transfers: Assignments must be recorded with JIPO to be legally effective against third parties.
- Licensing: Trademark license agreements should be officially recorded with JIPO to produce legal effect against third parties.
- Changes of Name/Address: Official recording with JIPO is required to maintain accurate title on the register.

- Jamaica Intellectual Property Office (JIPO): Administrative authority managing oppositions, cancellations, and recordals.
- Supreme Court of Jamaica: Exercises jurisdiction over judicial trademark infringement suits, claims for commercial damages, permanent injunctions, passing off actions, and appeals from JIPO decisions.
- Well-Known Marks: Protected under the Trade Marks Act, 1999 and Article 6bis of the Paris Convention.
- Customs Enforcement: Brand owners can coordinate with the Jamaica Customs Agency (JCA) to inspect, detain, and seize suspected counterfeit shipments at ports of entry.
