Competent Authority & System
Official Authority: Icelandic Intellectual Property Office (ISIPO) / Hugverkastofan.
Official Language: Icelandic (English is widely accepted for initial processing and documentation).
System: National IP system. Iceland is an EEA Member State, but it is not a member of the European Union (EU); European Union Trademarks (EUTM) do not cover or extend to Iceland.
International Treaties
Madrid System: Member of the Madrid Protocol (since April 15, 1997). Iceland can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial priority filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident applicants established outside the European Economic Area (EEA) must be represented by a registered local representative residing or established in an EEA member state.
Power of Attorney (POA): A simple signed Power of Attorney is accepted. Notarization or Legalization/Apostille is not required.
Online Services & Database
E-Filing: E-filing is fully operational through the official ISIPO digital portal (Mínar síður).
Free Trademark Search Database: Public searches can be conducted free of charge via the official ISIPO Register Portal, as well as TMview and the WIPO Global Brand Database.
Registrable Mark Types
Types: Words, logos/figurative marks, 3D shapes/packaging, color combinations, sounds, motion, multimedia, and position marks capable of clear visual or digital representation in the register.
Foreign Characters & Translation: Signs featuring non-Latin characters or non-Icelandic terms must include a transliteration into the Latin alphabet and an Icelandic/English translation upon request.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided they comply with standard clarity and precision guidelines.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by ISIPO (distinctiveness, descriptiveness, genericness, public policy, deceptive signs).
Relative Grounds: ISIPO conducts a substantive ex officio search for prior identical or confusingly similar registered marks and pending applications. If a conflict is found, ISIPO issues a provisional refusal/office action.
Office Action Deadlines: Response to formal deficiency notices or provisional refusals is typically required within 2 months from official notification.
Publication & Opposition
Opposition Window: 2 months starting from the publication date of the trademark registration in the official IP Gazette (Einkaleyfablaðið).
Standing: Owners of earlier registered national trademarks, international registrations designating Iceland, pending applications with earlier priority, well-known marks, or trade names.
Timeline & Expedited Examination
Average Timeframe: Approximately 2 to 4 months from filing to registration in smooth cases without office objections or third-party oppositions.
Expedited Examination: Fast-track processing is available upon request and payment of an official urgency fee.
Official Fees
Official statutory fees at ISIPO are assessed in Icelandic Króna (ISK):
Base Application Fee (1st Class): ISK 40,600.
Additional Class Fee: ISK 8,900 per class exceeding the 1st.
Renewal Fee (1st Class): ISK 40,600.
Renewal Additional Class Fee: ISK 8,900 per class exceeding the 1st.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal requests can be submitted up to 6 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to an official late payment surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it has not been put to genuine commercial use in Iceland for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges/mortgages, and changes of corporate details (name/address) must be officially registered with ISIPO to be legally binding against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation claims and absolute/relative invalidity actions can be filed administratively with ISIPO or brought directly before competent courts in Reykjavik.
Customs Enforcement: Rights holders can file border detention applications with the Icelandic Customs Authority (Skatturinn) to intercept counterfeit goods at the border.
Country-Specific Risks & Practical Insights
No Automatic EU Coverage: Because Iceland is an EEA member but not an EU member state, European Union Trademarks (EUTM) do not extend to Iceland. Direct national filings or Madrid System designations ("IS") are strictly required.
Post-Registration Opposition System: ISIPO registers and publishes trademarks before opening the 2-month opposition window. If an opposition succeeds, the mark is retroactively revoked.
Ex Officio Relative Search: ISIPO examiners actively reject confusingly similar applications ex officio during examination, reducing the likelihood of identical squatting.
