Official Authority: Estonian Patent Office / Patendiamet.
Official Language: Estonian.
System: National IP system. As an EU Member State, protection in Estonia can also be obtained via European Union Trademarks (EUTM) administered by EUIPO.
International Treaties
Madrid System: Member of the Madrid Protocol (since November 18, 1998). Estonia can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Applicants residing or established outside the European Economic Area (EEA) must be represented by a registered Estonian representative (patent agent).
Power of Attorney (POA): A simple signed Power of Attorney is sufficient; notarization or Legalization/Apostille is not required. The POA can be submitted late within 2 months from the application filing date.
Online Services & Database
E-Filing: E-filing is fully operational through the Estonian Patent Office e-services portal (e-Patendiamet).
Free Trademark Search Database: Publicly searchable via the official Patendiamet online register, as well as TMview, EUIPO eSearch plus, and the WIPO Global Brand Database.
Registrable Mark Types
Types: Word, figurative, combined/logo, 3D shapes/packaging, color, sound, motion, multimedia, pattern, and position marks capable of clear visual or digital representation.
Foreign Characters & Translation: Signs containing non-Latin scripts or foreign words must include a transliteration into the Latin alphabet and a translation into Estonian.
Classification Framework
Nice Classification: Uses the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided they conform to standard EU common practice (IP TRANSLATED principles) for clarity and precision.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by Patendiamet (distinctiveness, descriptiveness, genericness, public order, deceptive signs).
Relative Grounds: Patendiamet does not refuse applications ex officio based on prior conflicting marks. Earlier rights holders are notified and must defend their rights via the opposition process or post-grant cancellation.
Office Action Deadlines: Response to formal deficiency notices or provisional refusals on absolute grounds is typically required within 2 months (extendable for an official fee).
Publication & Opposition
Opposition Window: 2 months starting from the publication date of the notice concerning the decision to register the trademark in the official gazette (Eesti Kaubamärgileht). Oppositions are filed with the Industrial Property Board of Appeal.
Standing: Owners of earlier registered national/EU trademarks, pending applications with earlier priority, or well-known marks.
Timeline & Expedited Examination
Average Timeframe: Approximately 6 to 10 months from filing to registration under standard processing.
Fast-Track / Accelerated Examination: Available via automated fast-track or fast-processing options, significantly shortening initial examination.
Official Fees
Official statutory fees at Patendiamet are assessed in Euros (EUR):
Base Application Fee (1st Class - Individual Mark): €145.
Additional Class Fee: €45 per class exceeding the 1st.
Collective / Certification Mark Base Fee: €195 (plus €45 per additional class).
Separate Registration Fee: €0 (Under the updated Trade Marks Act, no separate registration fee applies after filing).
Standard Renewal Fee (10 years - 1st Class): €195.
Restoration / Grace Period Surcharge: €45.
Recordal of Assignment / License: €32.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal applications can be filed within 12 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to an official late restoration fee surcharge of €45.
Use Requirements & Priority System
Priority System: First-to-file system. Rights can also be acquired through sufficient public recognition (well-known marks).
Non-Use Cancellation: A registered trademark becomes vulnerable to revocation on non-use grounds if it is not put to genuine commercial use in Estonia for a continuous period of 5 years following registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate name/address must be officially registered in the State Register at Patendiamet to be legally binding against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and absolute/relative invalidity claims are filed with the Industrial Property Board of Appeal or brought directly before the competent civil courts in Estonia.
Customs Protection: Rights holders can file applications for customs border detention under EU Customs Regulation (EU) No 608/2013 to stop counterfeit goods at Estonian ports and borders.

No Separate Grant Fee: Estonia removed separate registration/grant fees under recent legal updates; paying the initial filing fee covers the entire process through registration.
Strict 2-Month Opposition Window: The opposition period before the Board of Appeal is 2 months from official gazette publication (shorter than the standard 3-month window used in many EU countries).
Ex Officio Absolute Grounds Only: Patendiamet evaluates absolute grounds only. Third-party monitoring is essential to intercept confusingly similar filings during the 2-month opposition window.
