Official Authority: Industrial Property Office of the Czech Republic / Úřad průmyslového vlastnictví (IPO CZ / ÚPV).
Official Language: Czech.
System: National IP system. As an EU Member State, protection in Czechia can also be obtained via European Union Trademarks (EUTM) administered by EUIPO.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol. Czechia can be designated in international applications through WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial filing date.
Applicant & Representation Requirements
Entitlement: Natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident applicants from outside the European Union (EU) or European Economic Area (EEA) must be represented by an authorized local representative (a Czech representative registered with the Chamber of Representatives or an advocate registered with the Czech Bar Association).
Power of Attorney (POA): Required. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required.
Online Services & Database
E-Filing: Electronic application submission is available directly via the IPO CZ e-portal.
Free Trademark Search Database: Public searches can be conducted free of charge via the official IPO CZ register database (e-database), as well as TMview, EUIPO eSearch plus, and WIPO Global Brand Database.
Registrable Mark Types
Types: Words, figurative/logos, 3D shapes/packaging, position, pattern, color combinations, sounds (audio file or score), motion, multimedia (MP4), holograms, and other signs capable of being clear and precise in the register.
Foreign Characters & Translation: Applications containing non-Latin scripts or non-Czech words must include a transliteration into the Latin alphabet and a translation into Czech.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Base Class Inclusion: The basic national filing fee covers up to 3 classes.
Class Headings: Accepted, provided they comply with standard EU common practice (IP TRANSLATED principles) for clarity and precision.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by IPO CZ (distinctiveness, descriptiveness, genericness, public order, deceptive signs).
Relative Grounds: IPO CZ does not ex officio examine or refuse applications based on prior conflicting trademarks. Relative grounds are evaluated solely through the third-party opposition procedure or post-grant cancellation.
Office Action Deadlines: Response to formal deficiency letters or provisional refusal notices is typically required within 2 months from official notification.
Publication & Opposition
Opposition Window: 3 months (non-extendable) starting from the publication date of the application in the Official Gazette (Věstník ÚPV).
Standing: Owners of earlier registered trademarks, pending applications with earlier priority, or well-known marks under Article 6bis of the Paris Convention. Opponents may be requested by the applicant to provide proof of genuine use if the prior mark has been registered for more than 5 years.
Timeline & Expedited Examination
Average Timeframe: Approximately 4 to 6 months from filing to registration in smooth cases without office objections or oppositions.
Expedited Examination: Fast-track examination procedures are not standardly offered as a separate commercial track, though smooth digital filings move relatively fast.
Official Fees
Official statutory fees at IPO CZ are set in Czech Koruna (CZK):
Filing Fee (Up to 3 Classes - Individual Mark): 5,000 CZK.
Filing Fee (Up to 3 Classes - Collective/Certification Mark): 10,000 CZK.
Additional Class Fee (From 4th Class onward): 500 CZK per class.
Opposition Fee: 1,000 CZK.
Renewal Fee (Standard - 10 years): 2,500 CZK.
Renewal Fee in Grace Period: 5,000 CZK.
Recordal of Assignment: 600 CZK.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal applications can be submitted up to 12 months prior to the expiration date.
Grace Period: A 6-month grace period following expiration is allowed for late renewal submissions, subject to an official late surcharge (fee increases from 2,500 CZK to 5,000 CZK).
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it is not put to genuine commercial use in Czechia for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered with IPO CZ to be enforceable against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use cancellation and absolute/relative invalidity claims are filed administratively with IPO CZ or brought before competent courts in Prague.
Customs Enforcement: Rights holders can file applications for customs border measures with the General Directorate of Customs of the Czech Republic under EU Customs Regulation (EU) No 608/2013 to intercept counterfeit goods.
