International Treaties

- Applicants who do not reside in or have a real and effective commercial establishment in Curaçao must be represented by an officially registered local trademark agent (merkgemachtigde).
- Power of Attorney (POA): Required. A signed Authorization / Power of Attorney form appointing the local agent is required. Formal consular legalization or Apostille is generally not strictly required for routine trademark representation.

Examination
- Examination Sequence: BIP Curaçao conducts Formal Examination followed by Substantive Examination on absolute grounds.
- Absolute Grounds: Examined for distinctiveness, generic terms, descriptiveness, deceptiveness, public order, and morality.
- Relative Grounds (Prior Rights): BIP Curaçao does not examine or reject applications ex officio based on relative grounds (prior conflicting registrations); prior rights conflicts are addressed strictly through judicial litigation.
- Office Actions: Applicants are granted a statutory response window to respond to official objections or formal requirements issued by the examiner.
Publication & Opposition
- No Administrative Opposition System: Under the National Trademark Ordinance 1995, Curaçao law does not provide for an administrative opposition procedure before BIP Curaçao prior to or after registration.
- Publication & Invalidation: Approved marks are published in the official Trademarks Journal (Merkenblad) upon registration. Third parties claiming prior conflicting rights must initiate formal invalidation or cancellation proceedings before the local Courts of First Instance.

Term of Protection & Renewal
- Protection Period: 10 years calculated from the application filing date.
- Renewal Requirements: Renewable for consecutive 10-year terms indefinitely.
- Grace Period: A 6-month grace period is granted after the expiration date to file for late renewal, subject to an official late fee surcharge (ANG / Cg 150.00).
Use Requirements & First-to-File vs. First-to-Use
- First-to-File System: Curaçao operates primarily on a First-to-File principle. Ownership rights are established through valid registration.
- Declaration of Use: Not required prior to registration or during routine 10-year renewal filings.
- Non-Use Cancellation: A registered trademark becomes vulnerable to non-use cancellation (vervallenverklaring) before the court if it has not been genuinely used in trade within Curaçao for a continuous period of 5 years following registration, without valid reasons for non-use.
Post-Registration Transactions
- Assignments & Transfers: Assignments must be officially recorded with BIP Curaçao to be enforceable against third parties.
- Licensing: Trademark license agreements should be officially recorded with BIP Curaçao to produce legal effect against third parties.
