International Treaties
- Paris Convention: Member. Priority can be claimed within 6 months from the first foreign filing date.
- Madrid Protocol: Member. Foreign applicants can designate Belize in an International Registration (IR) via WIPO, and national applicants can use BELIPO as an Office of Origin.
Applicant Eligibility & Representation
- Eligible Applicants: Natural persons and legal entities (both domestic and foreign).
- Local Representation / Agent Requirements:
- Applicants whose residence or principal place of business is outside Belize must appoint an authorized local representative/representative and provide an Address for Service in Belize.
- Power of Attorney (POA): Required (Form No. 2 - Authorization of Agent). The document must be executed before a Notary Public.
- Late Submission: Scanned copies of the notarized Authorization of Agent form can be submitted electronically at filing, provided the original notarized document reaches BELIPO within 30 days.
Online Application & Search Database
- Electronic Filing: Administrative forms and submissions are handled via BELIPO's portal and electronic administrative channels.
- Public Search Database: BELIPO maintains an official registry database. Public searches can be conducted via formal request or through WIPO's Global Brand Database.
Registrable Mark Types
- Standard & Non-Traditional Marks: Words, figurative/logo designs, letters, numerals, 3D shapes/packaging, distinct color combinations, sound marks, and collective/certification marks.
- Translation & Transliteration: Applications incorporating non-English wording or non-Latin scripts require an accurate certified English translation and phonetic transliteration.
Classification System
- Classification Standard: Nice Classification system.
- Multi-Class Applications: Allowed, but capped at a maximum of 5 classes per application file. Coverage beyond 5 classes requires filing a separate application.
- Class Headings: BELIPO utilizes standard Nice terms and terms recognized in the TMclass database; clear itemization of goods and services is required.
- Class Fees: Per-class surcharge structure applies.
Examination
- Examination Sequence: BELIPO conducts Formal Examination followed by Substantive Examination (absolute and relative grounds).
- Absolute Grounds: Examined for distinctiveness, genericness, descriptiveness, deceptiveness, public order, and morality.
- Relative Grounds (Prior Rights): Examined ex officio for likelihood of confusion against prior registered marks or pending applications.
- Office Actions: Applicants are granted a statutory response period (typically 2 to 3 months) to respond to official objections or examiner refusals.
Publication & Opposition
- Publication: Formally approved applications are published in 3 consecutive fortnightly issues of the official Intellectual Property Journal.
- Opposition Period: 12 weeks from the date of the first publication in the Intellectual Property Journal.
- Eligible Opponents: Any interested third party claiming prior rights or statutory grounds of non-registrability.
- Official Opposition Fee: BZD $225.00.
Timeframe & Acceleration
- Average Timeframe: A smooth, un-opposed trademark application takes approximately 6 to 12 months from filing to certificate issuance.
- Expedited Examination: No official fast-track fee system is provided; applications are examined in order of receipt.

- Additional Class Fee (up to 4 additional classes, max 5 classes total): BZD $100.00 per class.

Term of Protection & Renewal
- Protection Period: 10 years calculated from the application filing date.
- Renewal Requirements: Renewable every 10 years indefinitely. Renewal applications can be filed prior to expiry.
- Grace Period: A 6-month grace period is provided following expiration for late renewal, subject to a late fee. An additional 6-month restoration period is available under statutory conditions.
Use Requirements & First-to-File vs. First-to-Use
- First-to-File System: Belize operates primarily under a First-to-File system, though prior common law rights or prior use can be raised during opposition/invalidation proceedings.
- Intent-to-Use / Declaration of Use: The application requires a statement affirming actual use or a bona fide intention to use the mark in Belize.
- Non-Use Revocation: A trademark registration becomes vulnerable to non-use revocation (revocation for non-use) by an interested party if it has not been put to genuine commercial use in Belize for a continuous period of 5 years following registration, without valid reasons for non-use.
Post-Registration Transactions
- Assignments & Transfers: Assignments must be recorded with BELIPO to be enforceable against third parties. Official fee: BZD $225.00.
- Licensing: Trademark license contracts must be officially recorded with BELIPO to produce legal effect against third parties. Official fee: BZD $225.00.
- Changes of Name/Address/Agent: Must be officially recorded with BELIPO. Official fee: BZD $225.00.
Enforcement & Legal Remedies
- Tribunals & Courts:
- Belize Intellectual Property Office (BELIPO): Handles administrative opposition, revocation, and invalidation proceedings.
- Supreme Court of Belize: Exercises jurisdiction over judicial infringement actions, damage claims, permanent injunctions, and appeals from BELIPO decisions.
- Well-Known Marks: Protected under the Trade Marks Act and Article 6bis of the Paris Convention.
- Customs Protection: Brand owners can file a formal restriction/forfeiture notice with the Belize Customs and Excise Department to intercept and seize counterfeit imports.
Country-Specific Risks & Practical Notes
- Multi-Class Limit Cap: Belize allows multi-class filings, but strictly limits each application file to a maximum of 5 international classes. Applications covering more than 5 classes must be split into separate application filings.
- Triple Journal Publication: The application notice is published across 3 consecutive fortnightly issues of the Intellectual Property Journal. The 12-week opposition window is measured directly from the first publication date.
- 30-Day Original Document Mandate: While scanned notarized Authorization of Agent forms (Form No. 2) are accepted for initial electronic filing, failure to submit the physical notarized original within 30 days will cause administrative delays or rejection.
