Applicant & Representation Requirements
Entitlement: Natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Foreign natural persons or legal entities without a permanent residence, domicile, or real business establishment in Belarus must be represented by a registered Belarusian patent/representative.
Power of Attorney (POA): Required. A simple signed POA is sufficient (no notarization or legalization/apostille required unless the signatory acts without standard corporate authority). The original signed POA must be submitted within 2 months from the application filing date.

E-Filing: Available electronically via the NCIP web platform and client services.
Free Trademark Search Database: Official trademark information and state register searches are accessible via the NCIP website and indexed in WIPO’s Global Brand Database.
Registrable Mark Types
Types: Word, figurative, combined/logo, 3D/packaging, color combinations, sound, and other signs capable of distinguishing goods or services.
Foreign Characters & Translation: Applications containing foreign languages or non-Cyrillic characters must include a transliteration into the Cyrillic alphabet and a Russian/Belarusian translation.
Classification Framework
Nice Classification: Uses the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided the designated goods or services are sufficiently clear and specific.
Examination Process
Examination Scope:
Preliminary (Formal) Examination: Conducted within approximately 2 to 4 months to verify document completeness and payment of official fees.
Substantive Examination: Conducted by NCIP examiners covering both absolute grounds (distinctiveness, descriptiveness, public policy) and relative grounds (ex officio search for earlier identical or confusingly similar registered marks and pending applications).
Office Action Deadlines: Standard response time for formal deficiencies or provisional refusals issued during substantive examination is 3 months from the date of official notification (extendable upon request).
Publication & Opposition
Opposition System: Belarus does not maintain a traditional pre-grant publication and third-party opposition window.
Informal Observations / Appeals: Third parties may submit informal written observations during substantive examination prior to registration. Once registered, invalidation claims based on relative or absolute grounds must be submitted post-grant to the Board of Appeals at NCIP or the Supreme Court of the Republic of Belarus.
Timeline & Expedited Examination
Average Timeframe: Approximately 10 to 14 months for standard processing in smooth cases.
Accelerated Examination: Official fast-track services are available at NCIP for an additional state fee, allowing preliminary examination to be reduced to 5–10 working days and substantive examination to as short as 1 month.
Official Fees
Official statutory fees at NCIP are set in Belarusian Rubles (BYN):
Filing & Preliminary Examination Fee: BYN 1,710 (covers the 1st class).
Additional Class Fee: BYN 225 per class exceeding the 1st.
Official fees for registration certificate issuance and renewals are adjusted periodically by state tariff schedules.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal requests can be filed within 12 months prior to the expiration date.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal submissions, subject to an official late fee surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: Registered trademarks become vulnerable to non-use cancellation if not put to genuine commercial use in Belarus for a continuous period of 3 years following registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during standard 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licenses, pledges, and changes of corporate name/address must be officially registered with NCIP to be legally enforceable against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use cancellation claims are brought directly before the Judicial Board for Intellectual Property Cases of the Supreme Court of the Republic of Belarus. Absolute/relative invalidity claims are examined administratively by the Board of Appeals at NCIP.
Customs Enforcement: Rights holders can register trademarks in the Customs IP Register (TKS) of the State Customs Committee of Belarus to halt counterfeit imports at the border.
