Madrid System: Member of both the Madrid Agreement and the Madrid Protocol. Azerbaijan can be designated in international applications via WIPO.

Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities are eligible to apply.
Representation for Foreign Applicants: Non-resident foreign natural persons or legal entities without a domicile or place of business in Azerbaijan must act through a registered local patent/representative.
Power of Attorney (POA): Required. A simple signed (and stamped, if applicable) POA is accepted. Notarization or Legalization/Apostille is generally not required unless specifically requested by the Agency under doubt.
Online Services & Database
E-Filing: E-filing is available through the Agency’s official digital platform (PƏNAH online system).
Free Trademark Search Database: Accessible through the official IP Agency database and indexed via WIPO’s Global Brand Database.
Registrable Mark Types
Types: Words, personal names, letters, numbers, graphic/figurative elements, 3D shapes/packaging, color combinations, and signs capable of distinguishing goods or services.
Foreign Characters & Translation: Applications must be submitted in Azerbaijani. If a sign contains foreign text or non-Latin script, an Azerbaijani translation and transliteration must be provided within 2 months.
Classification Framework
Nice Classification: Applies the current active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided the goods and services are clear and properly classified.
Examination Process
Examination Scope:
Preliminary (Formal) Examination: Completed within 1 month from the filing date.
Substantive Examination: Completed within 6 months after preliminary examination. The Agency examines both absolute grounds (distinctiveness, descriptiveness) and relative grounds (ex officio search for prior identical/similar conflicting marks).
Office Action Response Deadline: Applicants are given an official timeframe (typically 2 months) to respond to deficiency notices or provisional refusals.
Publication & Opposition
Opposition System: Azerbaijan does not operate a traditional pre-registration opposition period after application publication.
Informal Observations: Third parties may submit informal written observations during the substantive examination stage before a final grant decision is made.
Post-Registration Invalidation: Once registered, prior rights holders can challenge the registration through administrative or judicial cancellation/invalidity proceedings.
Timeline & Expedited Examination
Average Timeframe: Approximately 6 to 10 months for standard registration without office actions.
Accelerated Examination: Available upon request and payment of an official urgency fee of AZN 180, reducing substantive examination from 6 months down to 1 month.
Official Fees
Official statutory fees are assessed in Azerbaijani Manat (AZN):
Filing & Examination Fee (1st Class): 263 AZN.
Additional Class Fee: 60 AZN per class.
Registration & Certificate Issuance Fee: 35 AZN per class (or 45 AZN base certificate grant fee).
Accelerated Examination Surcharge: 180 AZN.
Renewal Fee (10-year term): 143 AZN.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year periods.
Grace Period: A 6-month grace period is granted post-expiration for late renewal payment, subject to an official late surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes vulnerable to revocation on non-use grounds if it is not put to genuine commercial use for a continuous period of 5 years following registration.
Declaration of Use: No periodic declaration or affidavit of use is required during standard 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, changes of name, and changes of address must be officially registered with the Agency to be enforceable against third parties.
Official Transaction Fees: Assignment registration costs 60 AZN; license agreement recordal costs 80 AZN (or 120 AZN depending on contract structure).
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and invalidity claims based on absolute or relative grounds are submitted to the Agency’s Board of Appeal or brought before competent commercial courts in Azerbaijan.
Customs Enforcement: Trademark owners can register their rights with the State Customs Committee of the Republic of Azerbaijan for border enforcement against counterfeit goods.

No Pre-Grant Opposition Window: Because there is no formal pre-registration opposition period, brand monitoring must rely on submitting informal third-party observations quickly during examination or filing post-grant invalidation actions.
Ex Officio Relative Search: The Agency actively rejects confusingly similar marks during substantive examination, providing robust protection against squatters even without a pre-grant opposition window.
Strict Translation Requirements: Failure to supply an official Azerbaijani translation and transliteration for foreign script or word elements within 2 months of filing can lead to application abandonment.
