International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol. Armenia can be designated in international registrations via WIPO.
Paris Convention: Member state; priority can be claimed within 6 months from the initial application filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident natural or legal persons without a domicile or place of business in Armenia must be represented by a registered local Armenian patent/representative.
Power of Attorney (POA): Required. A simple signed (and stamped, if applicable for legal entities) POA is accepted. Notarization or Legalization/Apostille is generally not required unless requested under specific doubts or if the entity does not use an official seal. The POA can be late-filed within 2 months from the application filing date.
Online Services & Database
E-Filing: Available electronically through the official AIPO portal ().
Free Trademark Search Database: Public trademark registers and search utilities are accessible via the official AIPO online system and indexed in WIPO's Global Brand Database.
Registrable Mark Types
Types: Word marks, figurative elements/logos, 3D/shape marks, color combinations, sounds (notated), holograms, and non-traditional marks capable of being graphically represented.
Foreign Characters & Translation: If a mark contains non-Armenian words or non-Armenian script, a transliteration into the Armenian alphabet and a literal translation into Armenian must be submitted.
Classification Framework
Nice Classification: Uses the latest active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided the goods and services are clear and specified according to Nice requirements.
Examination Process
Examination Scope:
Formal Examination: Conducted within 10 working days following the filing date.
Absolute & Relative Grounds: AIPO conducts substantive examination covering both absolute grounds (lack of distinctive character, descriptiveness, public policy) and relative grounds (conflict with earlier registered or applied-for marks).
Office Action Response Deadline: Applicants typically have 2 months to respond to provisional refusals or office actions issued by AIPO.
Publication & Opposition
Opposition Period: 2 months following the publication of the application in the official IP bulletin.
Standing: Any interested party or holder of prior conflicting rights (earlier marks, trade names, or well-known signs) may submit an opposition.
Timeline & Expedited Examination
Average Timeframe: Approximately 5 to 8 months for standard registration without office actions or oppositions.
Expedited Examination: Official fast-track processing procedures are not standardly available.
Official Fees
Statutory fees are fixed in Armenian Dram (AMD):
Application / Filing Fee: AMD 30,000 (covers 1st class).
Substantive Examination Fee: AMD 40,000.
Additional Class Fee: AMD 15,000 per class exceeding the 1st.
Registration & Certificate Issuance Fee: AMD 50,000.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Application for renewal can be filed within 12 months prior to expiration.
Grace Period: A 6-month grace period is granted post-expiration for late renewal, subject to an official surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered mark becomes subject to revocation/cancellation on non-use grounds if it is not used in genuine commerce in Armenia for a continuous period of 5 years post-registration.
Declaration of Use: Maintenance declarations of use are not required during routine renewals.
Post-Registration Transactions
Recordals: Rights transfers/assignments, license agreements, changes of name, and changes of address must be officially recorded with AIPO to be enforceable against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use cancellation claims and invalidity actions based on absolute/relative grounds can be brought before the competent court in Armenia.
Customs Protection: Brand owners can file an application for customs recordal with the Customs Service of the Republic of Armenia to suspend infringing or counterfeit goods at the border.
Country-Specific Risks & Practical Insights
Script & Translation Formalities: Because Armenian employs a unique non-Latin alphabet, filing verbal elements in Latin script alone leaves room for third parties to register phonetically similar Armenian script marks. It is recommended to register both the Latin and Armenian transliterations.
POA Deadline: Ensure the simple POA is provided within the strict 2-month deadline to avoid application abandonment.
